I think it depends on how long the audio clip is.  You will probably have to pay royalties though.  From what I remember about my music business class, you probably shouldn't use without permission it if you don't want to get into legal trouble.

I have a buddy that is a pro photographer, and the general stance on this is that if you use the image to make a profit the artist should receive an appropriate portion of that profit.
